After registration issues, the owner of record must periodically file certain documents and pay government fees to keep the registration alive. To keep your registration alive, you must file a “Declaration of Use under Section 8” between the fifth and sixth year following registration. In addition, you must file a combined “Declaration of Use and Application for Renewal under Sections 8 and 9” between the ninth and tenth year after registration, and every 10 years thereafter. There is a 6 month grace period to file the renewal forms after the 6th year at an additional cost of $100 per class.
We recommend filing a Declaration of Incontestability under Section 15 in conjunction with the initial maintenance filing. A declaration of incontestability establishes the owner's exclusive right to use the mark with the goods/services.
Failure to renew your registration within the statutory time period will result in the cancellation of the registration.
